Legal protection of fundamental rights and privacy in the face of automated decisions and algorithmic bias

Legal protection of fundamental rights and privacy in the face of automated decisions and algorithmic bias”

Dr. Qutaiba Qassem Al-Arab, international expert on international humanitarian law, human rights, victims of terrorism, and transitional justice, former visiting professor at Hassan II University in Morocco, President of the National Council for Human Rights, Syria.

Study summary:

The accelerating penetration of artificial intelligence systems into automated decision-making raises complex constitutional and legal issues. Traditional legal rules are no longer able to curb the risks of algorithmic bias, or protect users' digital privacy. This research stems from a central question about the adequacy of current legislation in the face of technical ambiguities “Black box” The resulting discrimination affects procedural justice. To dismantle this problem, we relied in this study on the analytical and comparative approaches, aiming to formulate an alternative governance framework based on two paths.: The first is objectively recognized “Individuals have the right to understand and interpret automated decisions” With imposition “Supervisory human intervention”The second is procedural, re-adapting the rules of risk-based civil liability by transferring the burden of proof to the party developing the system. The research concluded that complete reliance on the alleged programming objectivity practically leads to the objectification of humans and their reduction into a rigid statistical template.. Accordingly, the study recommends the necessity of adopting legal mechanisms that require independent algorithmic auditing, and modernizing digital litigation systems in line with contemporary international standards.

Abstract

This study addresses the profound legal and constitutional challenges arising from the rapid proliferation of automated decision-making systems and artificial intelligence applications. The research problem centers on two intertwined phenomena: systemic algorithmic bias and the erosion of the core of digital privacy and data sovereignty. The study aims to dismantle the “black box” dilemma to demonstrate its implications for constitutional and international protections, primarily the principle of non-discrimination and procedural due process. Employing critical analytical and comparative methodologies, the study evaluates the adequacy of traditional legal frameworks and proposes an alternative comprehensive governance model. This model is based on institutionalizing the “right to explanation” and enforcing mandatory “meaningful human intervention.” Furthermore, it advocates for activating strict risk-based liability rules and reversing the technical burden of proof in favor of the aggrieved party before courts. The findings reveal that automated decisions objectify individuals, reducing them to predictive statistical profiling that restricts their fundamental freedoms under the guise of misleading algorithmic objectivity. The study concludes with a set of legislative recommendations, most notably mandatory independent algorithmic auditing and the reform of digital litigation rules to align with modern international frameworks of 2026.

Firstly: Introduction to the study

Contemporary jurisprudence is facing a real crisis as a result of the penetration of artificial intelligence systems into the structure of administrative and judicial decisions. The use of algorithms is no longer just a regulatory technology, but has become an executive and sovereign authority on which state agencies, financial and security institutions directly depend.. Today, this digital transformation affects very sensitive constitutional rights, starting from assessing the creditworthiness of citizens and sorting out job competencies, all the way to modeling criminal risks and automating some of the work of the judicial authority..

However, this accelerated transition towards comprehensive digitization took place without legislative support ensuring software transparency, which led to the emergence of what is known as “Systematic algorithmic bias”. The machine's replacement of the human judge or employee has shifted the legal center of gravity from... “The authority of texts coupled with procedural guarantees” to “Closed code authority” (Black box). This new reality threatens the legal security of individuals and undermines their sovereignty over their personal data, in addition to passing on invisible discriminatory practices that reproduce societal biases and cover them with a misleading veneer of impartiality and technical objectivity..

The scientific and practical importance of the study

The academic and applied value of this research is evident in its response to one of the most complex dilemmas emerging in contemporary legal jurisprudence, and this importance is divided into two paths::

  • Addressing the legislative and jurisprudential gap: The study aims to highlight the shortcomings of traditional legal texts. Due to their stagnation in the face of the dynamic nature of artificial intelligence systems, which imposes the necessity of creating new rules of responsibility that are compatible with the specificity of these technologies..
  • Ensuring legal security and freedoms: The research emerges as a groundbreaking tool for establishing protective frameworks that prevent the wasting of constitutional guarantees - the most prominent of which are the sanctity of private life and the principle of neutrality, under the pretext of the desire to accelerate technical innovation or increase administrative efficiency..
  • Developing procedural and litigation rules: The research provides concrete practical solutions for the judicial facility, by proposing new mechanisms that suit the ambiguity of smart systems, such as shifting the burden of proof, codifying the right to understand and interpret the automated decision, as well as imposing dominant human control over the machine’s outputs..
  • Coupling with modern international governance: The research provides a legal approach that links local jurisprudence to the latest international legislative systems issued up to the year 2026 (Such as the strict European AI law)This paves the way for building a national legislative system that keeps pace with contemporary international standards.

The research problem and its interconnected questions

The main problem:

The central problem of this research revolves around the structural inability of traditional legal rules to confront disputes created by automated decision-making systems. The current texts fall short in finding an objective balance between protecting the right to privacy and providing effective remedies against software biases. Accordingly, the core question of the study can be formulated as follows: “How can an integrated legal and procedural framework be activated that guarantees the protection of the sanctity of personal data, and gives individuals the necessary judicial guarantees to confront algorithmic bias and automated decisions, without prejudice to the requirements of technical development?”

Sub-questions:

  • المحور الموضوعي (التقني والحقوقي): What is the scientific mechanism through which the processing of personal data via machine and deep learning algorithms turns into a tool for producing systematic discrimination against certain categories of individuals?
  • Constitutional axis (Protectionist): What are the limits and constitutional guarantees necessary to preserve digital privacy and establish sovereignty over data in the face of software blackout resulting from “The black box dilemma”؟
  • Governance axis (Organizational): How effective are new legal tools — such as the right to interpretation, the right to object, and mandatory human oversight — in curbing abuses resulting from fully automated decisions?
  • Procedural axis (Judicial):

Research objectives:

Through its legal and ethical approach, this study seeks to achieve a number of scientific and applied objectives, as follows:

  • Explaining the objective dimensions of algorithmic processing: Monitoring the technical components of personal data processing operations, and characterizing the problem of software ambiguity arising from technology “Black box”, while tracing the technical and societal roots that lead to systematic software bias.
Rebuilding the philosophical and legal framework for the concept of the inviolability of private life and data sovereignty in the digital age, consistent with international human rights law instruments, and curbing the risks of behavioral prediction and statistical modeling..
  • Measuring the effectiveness of contemporary legislative systems: Analyzing the strengths and weaknesses of leading legal and regulatory systems (Foremost among these are the European General Data Protection Regulation and the strict European Artificial Intelligence law)To demonstrate the extent of its procedural effectiveness in guaranteeing the rights of individuals against fully automated automated decisions.
Formulating a proposed legislative model that aims to modernize the rules of judicial evidence and digital disputes, while re-adapting the rules of civil and criminal liability for legal persons and technological companies developing smart systems..

Fifth: Research hypotheses :

This study is based on three central hypotheses that are intended to be tested and verified:

  • First hypothesis: It results in the lack of programming transparency and the opacity of smart systems (The black box dilemma) An inevitable undermining of procedural constitutional guarantees, foremost among which is the principle of the necessity of confrontation between opponents and the right to defence, which turns automated decisions into a tool of hidden discrimination that is difficult to prove by traditional methods..
  • Second hypothesis: The inability of classical tort liability rules based on proving due fault leads to depriving those affected by smart systems of effective remedies, which imposes the necessity of moving towards a system of objective liability based on bearing risks, and re-engineering the rules of proof by transferring its burden to the party operating or developing the technology..
The basic legislative pillar for protecting human rights and ensuring a balance between incentives for innovation and the requirements of justice

The nature of this study requires the combination of two scientific methodologies::

It is concerned with monitoring the substantive and procedural mechanisms of artificial intelligence systems and their algorithmic outputs, with the aim of measuring the extent of their compatibility with established rules in public and private law and international human rights covenants, leading to clarifying the deficits and deficiencies in the current legislative texts..
  • Comparative approach: It is followed by tracing and extrapolating the strict regulatory approaches issued in comparative legal systems and international organizations, especially the European Union legislative system represented by the General Data Protection Regulation. (GDPR)European Artificial Intelligence Law (I HAVE Act)And the principles established by comparative judiciary in this regard. In addition to accompanying the global guidelines issued by UNESCO on technology ethics, all with the aim of deriving a promising national legislative framework that avoids these emerging risks..

The first axis: The theoretical approach and structural problem of intelligent systems and algorithmic bias

1- The structural transformation of intelligent systems and its philosophical and ethical implications

The current technical boom and the increasing trend towards decision automation establishes a different legal reality that affects the architecture of legal centers and the mechanisms for distributing rights and obligations within the contemporary state.. The use of algorithmic systems is no longer limited to abstract technical support aimed at improving administrative facilities or facilitating commercial transactions, but rather has penetrated vital sectors that are closely linked to the freedoms inherent in humans.. This procedural influence is clearly evident in systems concerned with assessing creditworthiness and automating employment, as well as criminal justice paths that have come to rely on tools for security forecasting and judicial risk assessment, all the way to auditing entitlement to social welfare and government support..

However, this operational expansion has produced complex human rights crises that have presented classical legal theories with a structural challenge. Practical practice revealed the falsity of the hypothesis “Software neutrality”It showed that digital processing may turn into a hidden means of reproducing inherited class or ethnic discrimination and covering it with a kind of “Misleading digital objectivity”. In this regard, modern German jurisprudence warns that complete dependence on automated outputs leads to a dilemma “Digital stereotyping and objectification” للأفراد؛ Where a person is emptied of his independent constitutional entity and voluntary authority, turning from... “A legal entity that maintains dignity” To just “Predictive statistical model” Subject to forced classification and censorship (Spiecker gen. Döhmann, 2023; Wagner, 2024).

2- dilemma “Black box” And the darkness of algorithmic processing

The opacity of algorithmic processing represents the greatest obstacle to extending legal, executive and operational oversight of the judicial facility. This phenomenon crystallizes when smart systems rely on complex layers of mathematical calculations and artificial neural networks to issue their protective outputs. Which obscures the justifications and logical links behind obscure technical walls that even the engineering minds that programmed the system are unable to explain. (Pasquale, 2015; Burrell, 2016).

The effects of this problem are exacerbated in administrative and civil disputes. The affected person is unable to refute or appeal an automated decision based on hidden software matrices, which the companies that own them use as an excuse to prohibit their disclosure in order to protect them. And to protect intellectual property rights. Comparative jurisprudence explains that dilemma “Black box” It creates a state of procedural and cognitive inequality in judicial litigation. Due to the impossibility of proving the element of error or proving the bias of the machine by traditional methods, which necessarily leads to the paralysis of the classical rules of tort liability due to the absence of interpretation and programming transparency. (Borges, 2023; Ebers, 2024)

  • Bias derived from historical data: This is achieved when feeding smart systems with data that monitors previous discriminatory or unfair practices (Such as ethnic considerations, nationality, or geographic class differences)Which prompts the machine to perpetuate these distortions and reproduce them in the future under a veil “Infallible mathematical determinism” (Baroque & Himself, 2016).
  • Engineering bias and sampling representation: It arises as a result of software models relying on limited statistical samples that do not reflect societal diversity, as well as the tendency of developers to present the values of operational efficiency and commercial profitability at the expense of human rights approaches and humanitarian obligations while drafting the system’s codes. (O'Neil, 2016).
  • Cumulative reactive bias: It is generated by continuous self-simulation between smart systems and users’ behaviors and life biases, which leads to the isolation of individuals within closed digital bubbles that reproduce and amplify exclusionary patterns in a mechanical, repetitive manner. (Zuiderveen Borgesius, 2018).
  • Structural bias of programming mechanism: It is the bias inherent in the nature of strict technical rationality, which lacks artificial consciousness “Common human sense”؛ حيث تُنزل المنظومة القواعد الرياضية الجافة على الحالات الفردية لتعظيم النتائج التشغيلية، دون أدنى قدرة على استيعاب السياقات الأخلاقية أو تقدير الظروف الاستثنائية المحيطة بالإنسان المعروض أمرُه عليها (Zech, 2023)

The second axis: The human rights and legal dimensions of protecting privacy and digital sovereignty in the face of algorithmic processing

Digital privacy” And sovereignty over personal data

The content of the right to privacy underwent successive fundamental changes that affected his philosophy and stable jurisprudential theory. After this right arose in the late nineteenth century, by the way “The right to isolation and distance from others” According to the historical rooting of classical Anglo-American jurisprudence (Warren & Brandeis, 1890)And its subsequent development in the areas of Germanic jurisprudence to revolve around the constitutional guarantee closely related to the human entity, which is represented by “The right to informational self-determination” (Roßnagel, 2023)This concept has become impossible in the contemporary digital environment to go beyond the limits of traditional protectionism towards a deeper concept known as “Digital sovereignty over data” (Florida, 2018). The scope of protection is no longer limited to protecting the individual’s physical or spatial space against intrusion, but has expanded to include the informational, psychological, and behavioral environment from which a person’s integrated digital identity emerges. (A disease, 2020).

However, the operational method of smart systems based on the consumer hunger for big data has undermined this rootedness. Machine learning algorithms are based on digital mining mechanisms and generating inferential predictions. The jurisprudential danger of these technologies is crystallized in enabling operators to extract highly sensitive and confidential features and information about the identity of individuals. (Such as health conditions, intellectual orientations, and psychological characteristics) (Kühling & Buchner, 2024; Simitis, 2023).

2- The right to transparency and access to processing logic and the governance paradox

Transparency is the cornerstone of ensuring the rule of law, but the governance of the digital environment collides with what is known as...

(Kühling & Buchner, 2024).

(Ebers, 2024; Specht-Riemenschneider, 2025).

Where the review of the automated decision is entrusted to an employee whose role is limited to routine approval, affected by “Automation bias” Without having the time or competence to refute the system’s outputs (Mendoza & City graves, 2017).

(Roßnagel & Geminn, 2024; Wagner, 2025).

The third axis:

1- Violating the principle of non-discrimination and equality in light of international conventions and international approaches

(2) From the Universal Declaration of Human Rights, art (26) From the International Covenant on Civil and Political Rights (ICCPR)، اللتين تحظران التمييز بأي شكل كان وتلزمان الدول بكفالة حماية متساوية وفعالة للجميع [INDEX]. (OHCHR) Intelligent systems produce what is known as “Discrimination by proxy” (Proxy Discrimination) [INDEX]؛ وهي آلية تعتمد فيها الخوارزمية على معطيات تبدو محايدة في ظاهرها (كالرمز البريدي أو النمط الاستهلاكي) لكنها تُشكل انعكاساً مباشراً لعرق الفرد أو خلفيته الطبقية، مما يؤدي إلى مخرجات إقصائية غير مباشرة تعجز الأدوات القانونية التقليدية عن رصدها أو إثباتها، ويحيل التزامات الدول الدولية بحظر التمييز إلى نصوص معطلة (McGregor et al., 2019; OHCHR, 2023).

[INDEX]. The inherent constitutional rights guaranteed by Article (14) From the International Covenant on Civil and Political Rights (ICCPR) - At the forefront of which is the right to discuss evidence, the necessity of confrontation between opponents, and determining the reasons for arrest or conviction - it is now colliding with the darkness of the algorithms that obscure the operational justifications for the system. Which deprives the accused and his agent of refuting the statistical criteria that classified him as “عنصر عالي الخطورة”.

Derived from the behavioral patterns of other human groups, not based on his or her specific personal physical action (Pasquale, 2015; Zarsky, 2016). It represents an issue (State v. Loomis) The American judiciary is a clear witness to the danger of relying on software owned by the private sector (Like the COMPASS system) Under the pretext of protecting trade secrets, which hindered the defense’s right to challenge the reliability of the results. Modern criminal jurisprudence warns that this approach undermines the doctrine “The emotional conviction of the judge” To replace it with “Misleading mechanical certainty”Transforming the judiciary from a weighing balance of facts and exceptional humanitarian circumstances into an automated enforcement body for abstract software outputs. (Ferguson, 2024; Kehl et al., 2017).

real example :precedent (State v. Loomis) And warnings from the constitutional judiciary

Loomis, 2016) [INDEX]. وتتلخص وقائع هذه السابقة في طعن المتهم “Eric Loomis” His six-year prison sentence was unconstitutional, based on an automated risk assessment report produced by an algorithm (COMPASS) Confidentiality [INDEX]. The defense argued that procedural fairness and the constitutional right to confrontation were violated; Due to the prohibition of revealing the mathematical matrices and standards of the software system under the pretext of protecting the commercial secrets and intellectual property of the developing company [INDEX].

In its dual ruling, the Supreme Court ended up upholding the penalty based on a combination of other material evidence, but it established a new protective judicial doctrine that prohibits judges from relying exclusively or decisively on the outputs of artificial intelligence. [INDEX].

  2. Historical race and class bias warning:
  5. Warning of newness and lack of software update: Drawing the attention of the judicial authority to the fact that predictive models rely on old statistical studies and samples, and do not necessarily keep pace with emerging shifts in behavioral patterns and contemporary conditions of society. [INDEX].

This historic judiciary involves a clear and high-level judicial recognition of a dilemma “Black box”This confirms the study's hypothesis with certainty “التدخل البشري الفعال” The need to adapt procedural rules to preserve the presumption of innocence from digital invasion [INDEX].

3- – Protecting human dignity and personal freedom in the face of profiling and algorithmic determinism

The article requires (17) From the International Covenant on Civil and Political Rights (ICCPR) A total commitment not to expose individuals to any arbitrary or illegal interference with their privacy or the sanctity of their personal lives and transactions. Systematic digital tracking, biometric surveillance mechanisms, and behavioral exploration for the purposes of profiling through deep learning algorithms are a blatant and unprecedented violation of the constitutionally protected field of personal freedom and moral sanctity of the human being, bypassing the controls of legal necessity and proportionality..

When fateful decisions are formulated based on pre-fabricated predictive matrices, the solid core of human dignity is directly violated. The unique human entity is reduced to... (Florida, 2018; A disease, 2020).

These violations go beyond the traditional scope of the sanctity of private life, threatening what is known in modern constitutional jurisprudence as “The right to free development of the personality”; Proactive automated processing leads to the establishment of a doctrine “الحتمية الخوارزمية”. (Kühling & Buchner, 2024; Zuboff, 2019).

Fourth axis:

(Scherer, 2016; Chesterman, 2020):

  • Breaking the causal link and the independence of mechanistic development: (Foreseeability) (Borges, 2023).
(Spiecker gen. Döhmann, 2023).

(Borges, 2023; Koch, 2021).

(Reversal of the Burden of Proof) (Pasquale, 2015; Kaminski, 2019).

(Borges, 2023; Specht-Riemenschneider, 2025).

Towards international and national governance frameworks capable of achieving technological justice and corporate criminal and civil liability

Firstly: Insufficiency of self-regulatory mechanisms (Soft Law) The need for commanding organization (Hard Law)

International legislative policies have been based for decades on approaches “Self-regulation” (Self-Regulation) Flexible ethical codes to control artificial intelligence risks, based on voluntary guidance recommendations. However, practical practice has revealed the inability of these tools to curb algorithmic abuses. Due to the dominance of major technology companies (Big Tech)

Döhmann, 2023; Ebers, 2024). (Paal, 2024; Wagner, 2025).

secondly: Mechanisms for independent algorithmic auditing and establishing criminal and civil liability for legal entities

Where the conviction is attributed directly to the legal person as a result of his negligence in establishing adequate governance and digital control measures, without the need to prove criminal intent on the part of a specific programmer. (Wagner, 2025). (Borges, 2023; Roßnagel, 2024).

  • انقلاب المفاهيم الحمائية وتحقق الفرضية الأولى: أثبت البحث أن تغلغل النظم الذكية أحدث تحولاً مفاهيمياً نقل الحق في الخصوصية من إطاره المكاني والجسدي الكلاسيكي إلى عقيدة “Digital sovereignty over data” و**”The right to informational self-determination”**.

The inevitability of engineering the rules of responsibility and proof and verifying the second hypothesis: During the search for a structural deficit that requires the development of a theory of obligations and rules for digital litigation; This is through a comprehensive transformation from “The doctrine of error is the duty of proof” to “The doctrine of assumed objective liability based on facility risks”. This shift is associated with shifting the burden of technical proof from the injured party and directing it towards the dominant technological party

In English: Executive Summary: This comprehensive strategic policy report provides an authoritative, evidence-based legal and political evaluation of the de facto transitional administration in Syria. The report exposes "soft empowerment" tactics and the establishment of a covert "deep state" by political Islamist movements, alongside field documentation of systematic oil theft, energy resource plunder, severe property rights infringements (Qudsaya land expropriations), and engineered socioeconomic impoverishment. Furthermore, it documents explicit violations of the Convention on the Rights of the Child (CRC) through systemic ideological indoctrination and child mobilization in Deir ez-Zor. Warning against geopolitical exceptions, the report advocates for an imperative transition toward a civic state rooted in legislative moderation as the sole baseline for regional and international stability.
